Conditions and disclaimers for using the free Should I Bid? evaluation tool.

1. Service and operator

Should I Bid? (https://shouldibid.com) is a free, automated decision-support tool that helps you consider whether a tender may be worth pursuing. It is operated by Ibis Flow GmbH, Krumbacher Str 2, 92421 Schwandorf, Germany. Statutory particulars: Impressum.

By accessing or using the site you accept these terms. If you do not agree, do not use the service.

2. No professional advice

Outputs are informational only. They are not professional, financial, legal, tax, or procurement advice, and they are not a determination of eligibility, suitability (Eignung), or compliance with any tender procedure. You remain solely responsible for bid, pricing, qualification, and compliance decisions.

3. Analysis and accuracy

Guidance may be produced by browser-side heuristics and/or a server-assisted check that forwards limited fields via a same-origin API to an Alle Gewerke backend operated by the same company. Analysis can be incomplete, outdated, or wrong. Destination platforms (Alle Gewerke, TenderHub) have their own terms when you continue there.

4. Acceptable use

You may use the tool for legitimate business evaluation of tenders. You must not:

  • scrape, overload, or reverse-engineer the site or analysis API;
  • attempt to extract API keys, bypass rate limits, or disrupt service;
  • submit unlawful content or use the tool to harm others;
  • misrepresent outputs as certified legal or procurement determinations.

We may suspend or restrict access if we reasonably believe these rules are breached.

5. Intellectual property

Site design, branding, text, and software are owned by Ibis Flow GmbH or its licensors. You retain rights in tender text you submit. You grant us a limited licence to process that text solely to provide the evaluation and operate the service as described in the privacy notice.

6. Availability

The site is provided as-is and as-available. We may change, suspend, or discontinue features without notice and without obligation to keep historical outputs.

7. Liability

The service is free and informational. To the fullest extent permitted by applicable law, Ibis Flow GmbH is not liable for decisions you make based on outputs, for lost profits or opportunity, or for indirect or consequential damage arising from use of the site.

Nothing in these terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, or any liability that cannot be limited under mandatory German law (including product liability where applicable).

8. Privacy

Processing of personal data is described in our privacy notice and related TOMs. Those documents form part of the information we provide about the service.

9. Governing law and venue

These terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a merchant (Unternehmer) within the meaning of § 14 BGB, the courts of Amberg, Germany, shall have exclusive venue. Mandatory consumer protections remain unaffected where they apply.
